Confidentiality and Psychotherapy

This presentation will describe the 60 year history of the divergence between the increasingly weak legal protection of ordinary medical information and the increasingly stringent protection of the confidentiality of psychotherapy information. Special attention will be given to the origin of the "psychotherapy notes" provision in the HIPAA Privacy Rule and the way that provision circumscribes disclosures in insurers. The limitation of disclosure of other information to third party payers to the "minimum necessary" amount will also be explained.
