Procedures for the Release of Evidence
Place all evidence specimens in the Kit. Everything must be properly labeled and sealed. All unused parts should be labeled with "specimen not collected" and returned to he Kit. An explanation for why particular specimens were not collected should be included in the Kit.
All required information including the number of additional bags/containers should be filled out on the top of the Kit prior to sealing it with evidence tape. Store the completed Kit and clothing bags in a secure, refrigerated area until released to the police or for a period not less than 30 days.
Evidence may not be released from a hospital without the written authorization and consent of the informed minor or authorized third party if the patient is unable to understand or execute the release. An Authorization for Release of Information and Evidence Form should be completed. In addition to obtaining the signature of the patient or authorized third party on this form, signatures must be obtained from the hospital staff person turning over the evidence, and the law enforcement representative who picks up the evidence.
The original copy of the release form must be kept at the hospital and a copy must be given to the law enforcement representative. Only a law enforcement official or duly authorized agent should transfer physical evidence from hospitals to crime laboratories for analysis. Medical specimens, cultures and photographs should not be included in the Kit.
